The President has delegated a set of functions and authorities under section 8335 of the National Defense Authorization Act for Fiscal Year 2026 to the **Secretary of the Treasury** and the **Secretary of State**. The delegation is set out in a presidential memorandum dated October 28, 2026, and addressed to both secretaries. It appeared in the Federal Register on November 2, 2026\. The President cites the authority vested in the office by the Constitution and the laws of the United States, including section 301 of title 3, United States Code. The memorandum gives no separate effective date and states no purpose or reason for the delegation.

## Treasury Takes the Lead on Most Provisions

Under the memorandum, the Secretary of the Treasury, in consultation with the Secretary of State, receives the functions and authorities vested in the President by section 8335(a) of the Act, codified at 22 U.S.C. 10704(a). The memorandum adds a second step. Once the Secretary of State identifies sanctionable foreign persons, the heads of relevant executive departments and agencies receive the authority to implement those sanctions, commensurate with their respective areas of responsibility.

The Secretary of the Treasury alone receives the functions and authorities under sections 8335(c)(1) and 8335(d)(1) of the Act, and also those under section 8335(i). For section 8335(f), the Treasury Secretary again acts in consultation with the Secretary of State. The memorandum does not describe what any of these subsections require or permit. It only assigns who exercises them.

## State Department Role

The Secretary of State receives the functions and authorities vested in the President by section 8335(g) of the Act. Beyond that, the State Department's role under the memorandum is to identify sanctionable foreign persons under section 8335(a) and to be consulted by Treasury on sections 8335(a) and 8335(f). The memorandum names no individual, entity or country as a target. It does not identify any foreign person as sanctionable and imposes no sanctions itself.

## Scope Extends to Future Laws

Section 2 of the memorandum extends the delegations beyond the current statute. They apply to any provision of any future public law that is the same or substantially the same as the provision referenced. Any reference in the memorandum to an act is to be read as a reference to that act as amended from time to time. The delegations therefore remain in place if Congress amends section 8335 or re-enacts it in substantially the same form.

Section 3 authorizes and directs the Secretary of the Treasury to publish the memorandum in the Federal Register. The memorandum was signed at the White House in Washington on October 28, 2026, and filed on October 30, 2026\. It sets out no reporting requirements, deadlines or timelines for the departments that now hold these authorities.
